Mediation is a voluntary process that parties to a dispute can agree to use in order to find a way to reach a final compromise between them instead of taking their dispute to a judge. A mediator is a neutral person who is there to listen and help others listen so that a discussion can take place that can and often leads to a settlement. Mediations are done as closed-door, confidential sessions with a trained mediator and with counsel present with the parties, and if cases are not settled, a mediation will not harm your ability to take your matter to the court. Trials before judges, however, are costly and you can be putting all or your case into a win or lose proposition without hope of compromises.
